This End User Agreement ("Agreement") constitutes a legal contract between Ophir Market Online Store ("Ophir Market"), Consumer Edge Solutions OPC ("Consumer Edge Solutions"), and individuals or entities participating as Marketer or Shopper members in the EARNFINITYPLUS Loyalty Card program. Enrollment as a Marketer or Shopper member implies your agreement to the terms and conditions stated below:

1. Definitions

a. Marketer Member. An individual or entity engaged in promoting products or services through the Ophir Market Online Store platform using the EARNFINITYPLUS Loyalty Card program.

b. Shopper Member. An individual or entity making purchases through the Ophir Market Online Store platform using the EARNFINITYPLUS Loyalty Card program.

c. Loyalty Card. The EARNFINITYPLUS Loyalty Card issued by Consumer Edge Solutions OPC for use within Ophir Market Online Store's platform and its Merchant Partners.

2.Membership Eligibility

a. Marketer Member. Individuals or entities applying for Marketer membership must adhere to Ophir Market's marketing guidelines. Ophir Market reserves the right to approve or reject Marketer member applications.

b. Shopper Member. All individuals or entities are eligible to enroll as Shopper members by accepting the terms outlined in this Agreement and complying with Ophir Market's platform usage policies.

3. Use of Loyalty Card

a. Marketer Member Responsibilities. Marketer members agree to ethically promote products or services offered by Ophir Market Online Store. The use of the EARNFINITYPLUS Loyalty Card by Marketer members should align with the guidelines provided by Consumer Edge Solutions OPC.

b. Shopper Member Responsibilities. Shopper members agree to utilize the EARNFINITYPLUS Loyalty Card solely for making purchases within Ophir Market Online Store's platform. The EARNFINITYPLUS Loyalty Card has a validity period of one year from the date of issuance. To maintain access to the Loyalty Card benefits, members are required to renew their membership annually. Any unauthorized use or misuse of the Loyalty Card post its expiration date is strictly prohibited.

4. Payment Handling

a. Members explicitly acknowledge and agree that they do not have the authority to accept money on behalf of Ophir Market Online Store or Consumer Edge Solutions OPC. All payments related to purchases or transactions conducted through the EARNFINITYPLUS Loyalty Card program shall be deposited directly into the designated bank account(s) of the respective companies.

5. Data Privacy

a. All parties agree that data collected through the use of the Loyalty Card may be utilized for transactional and marketing purposes under applicable data protection laws.

b. Members' personal information and transaction data will be handled as per Ophir Market's Privacy Policy and Consumer Edge Solutions OPC's Privacy Policy.

6. Termination

a. Ophir Market reserves the right to suspend or terminate membership for Marketer or Shopper members found violating this Agreement or engaging in fraudulent activities.

b. Consumer Edge Solutions OPC reserves the right to revoke the Loyalty Card and terminate membership due to misuse or unauthorized use.

7. Amendments

a. Ophir Market and Consumer Edge Solutions OPC reserve the right to modify or amend this Agreement at their discretion. Notice of amendments will be communicated through appropriate channels.

b. By enrolling as a Marketer or Shopper member in the EARNFINITYPLUS Loyalty Card program, you acknowledge that you have read, understood, and agreed to comply with the terms and conditions outlined in this Agreement. Non-compliance with these terms may result in the termination of membership and associated privileges.
